Terms of Service
Last updated: 30 September 2026
These Terms of Service (“Terms”) govern your use of the SkillSpark app for iPhone (the “App”), the skillspark.ca website (the “Site”), and the in-app purchase sold in the App (together, the “Service”). SkillSpark is made by Player Piano AI, a division of Ayres Capital Enterprises LTD., a company incorporated in Ontario, Canada (“we”, “us”, “our”). By downloading or using the App, or by using the Site, you agree to be bound by these Terms.
1. Acceptance of these Terms
By using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. You must be of legal age to form a binding contract in your jurisdiction.
2. The App
- The App is free to download from Apple’s App Store. Every skill in the App has free lessons.
- You can use the App without an account. Without one, your progress is kept only on your phone.
- You can create an account with Sign in with Apple to save your progress to that account and restore it on another iPhone or after a reinstall.
3. The in-app purchase
- Unlock Everything is a single, one-time in-app purchase of $19.99 that opens all skills and lessons in the App. It is not a subscription and is never billed again.
- Apple sells the purchase and processes the payment. The purchase is governed by Apple’s terms for the App Store, including its Media Services Terms and Conditions, in addition to these Terms. Prices are set in the App Store and may vary by country.
- The purchase belongs to your Apple ID. You can restore it on any iPhone signed in with the same Apple ID using Restore Purchases in the App’s Profile tab.
- Refunds are handled by Apple, not by us. You can request one at reportaproblem.apple.com.
4. Your account
You can ask us to delete your account at any time by emailing support@skillspark.ca from the address on your account. Deleting your account does not refund the in-app purchase or remove it from your Apple ID. The Privacy Policy explains what we hold and how deletion works.
5. Use of the Service
You agree to use the Service lawfully and responsibly. You must not:
- Use the Service in any way that breaches applicable laws or regulations.
- Attempt to gain unauthorized access to the Service, its servers, or connected systems.
- Introduce viruses, malware, or other harmful code.
- Interfere with or disrupt the Service or other users’ use of it.
- Copy, scrape, or harvest content or data except as expressly permitted.
- Use the Service to transmit unsolicited or unauthorized advertising or spam.
We may suspend, restrict, or terminate your access at any time if you breach these Terms or for any reasonable operational or legal reason.

8. Disclaimers
The Service and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, express or implied, about the Service’s accuracy, completeness, reliability, fitness for a particular purpose, or availability. Content is for general information only and is not professional, legal, financial, or technical advice. We do not guarantee the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the fullest extent permitted by law, Ayres Capital Enterprises LTD. and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of (or inability to use) the Service. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid (if any) for the relevant product or service, or CAD $100, whichever is greater. Nothing here limits liability that cannot lawfully be limited, including for fraud or under Ontario or Canadian consumer-protection law.
10. Third-party services
The Service relies on third-party services, including Apple for the App Store, sign-in and payments. We are not responsible for their content, policies, or practices. Your use of them is subject to their terms.
11. Indemnification
You agree to indemnify and hold harmless Ayres Capital Enterprises LTD. and its representatives from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute, subject to any mandatory consumer-protection rights you may have.
13. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they were last changed. Changes take effect when posted on this page. Continued use of the Service after changes are posted means you accept the updated Terms.
14. Severability and entire agreement
If any provision is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Apple’s terms for the purchase, form the entire agreement between you and us regarding the Service.
